EULA - End User License Agreement

SOFTRECKON (“Licensor”) LICENSE

THE FOLLOWING TERMS AND CONDITIONS (THE “EULA”)
SET FORTH THE RIGHTS BEING LICENSED TO YOU (THE “CUSTOMER”)
FOR USE OF THIS SOFTWARE. THESE RIGHTS ARE THE ONLY RIGHTS YOU HAVE TO THE SOFTWARE,
SO IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO NOT USE THE SOFTWARE.
BY USING THIS SOFTWARE, YOU EXPRESSLY AGREE THAT ALL RISKS ASSOCIATED WITH THE
PERFORMANCE AND QUALITY OF THE SOFTWARE IS ASSUMED SOLELY BY YOU. YOU
ACKNOWLEDGE AND AGREE THAT YOU HAVE EXERCISED YOUR INDEPENDENT JUDGEMENT IN
ACQUIRING THE SOFTWARE.
TO THE EXTENT PERMITTED BY LAW, SOFTRECKON SHALL NOT BE LIABLE FOR ANY DIRECT,
INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE,
EVEN IF SOFTRECKON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE SOFTWARE IS MADE AVAILABLE BY SOFTRECKON "AS IS"
AND "WITH ALL FAULTS". TO THE EXTENT PERMITTED BY LAW, SOFTRECKON DOES NOT MAKE
ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED,
CONCERNING THE QUALITY, SAFETY OR SUITABILITY OF THE SOFTWARE, INCLUDING WITHOUT
LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, NON-INFRINGEMENT OR THAT THE SOFTWARE IS ERROR FREE.
This agreement cannot be changed or altered except by a written document signed
by you and SOFTRECKON. This agreement is governed by the laws in Ghana or in the USA.
Each party irrevocably and unconditionally submits to
the non-exclusive jurisdiction of the courts of law.
DECLARATION:
I hereby acknowledge that I have read and understand the foregoing License Agreement and agree that the
action of installing the Program is an acknowledgment of my agreement to be bound by the terms and
conditions of the License Agreement contained herein. I also acknowledge and agree that this License
Agreement is the complete and exclusive statement of the agreement between SOFTRECKON
and I and that the License Agreement supersedes any prior or contemporaneous agreement, either oral or
written, and any other communications between SOFTRECKON and myself.
